Ryan discussed how Supreme Court guidance may influence appellate courts to apply more rigorous class certification standards. He pointed to the Fourth Circuit as a prime example, where class certification decisions have come under increased scrutiny and the court has become more willing to hear appeals of certification grants pursuant to Rule 23(f).
