Logan Leonard Discusses California SB 690’s Impact on CIPA Claims in Daily Journal Article

Litigation attorney Logan Leonard authored an article published by the Daily Journal analyzing California’s SB 690 and its potential impact on website privacy litigation under the California Invasion of Privacy Act (CIPA).

On August 28, 2026, the California Legislature passed SB 690 to stem the tide of claims brought under the California Invasion of Privacy Act (CIPA) targeting commonplace website technologies. If Gov. Newsom signs it, the measure would eliminate the private right of action for internet-related claims under CIPA’s pen register and trap-and-trace device provision.

The change is retroactive to January 1, 2025, meaning it could eliminate many pending pen register claims and reduce alleged exposure by more than $5,000 per violation by preventing plaintiffs from stacking damages under multiple CIPA provisions for the same alleged conduct.

Logan noted, however, SB 690 would not end website privacy litigation in California. Plaintiffs would continue to have the ability to pursue claims under CIPA’s wiretapping provision and other privacy laws.
